1- Definitions.

+ espace-gold-change.com": concerns the company TRADING EL, whose registered office is at 5 place Charles Béraudier 69003 LYON, registered in the LYON Trade and Companies Register under number 531 970 366, whose commercial name is RAFY GOLD,

+ Precious Metals": refers to all items sent by the Customer & RAFY GOLD.

+ Customer": refers to any natural person of legal age who owns the metal free of any
pledge, and acquired under legal conditions, entering into a contract with RAFY GOLD.

+ RAFY GOLD Kit": refers to the equipment required by the Customer to ship his metal.

2- Corporate purpose.

RAFY GOLD buys back gold and silver for recycling.

3- Scope of application.

These Terms and Conditions apply to gold and silver repurchase contracts entered into between the Customer acting as "Seller" and RAFY GOLD acting as "Buyer".

Simply ordering the RAFY GOLD kit constitutes the Customer's unreserved acceptance of these General Terms and Conditions of Purchase.

4- Prerequisites for use,

The Customer declares to RAFY GOLD;

-That he/she is of full age and has full legal capacity.

- That he resides in France.

- That he is acting in a private capacity and not in a professional capacity.

- That he/she owns the property or is duly authorised to dispose of it.

- That the object is free of all rights.

- That the object does not result from an act contrary to conventions, laws and regulations.

- That the sale of the item is in no way illegal.

- That the sending, making available or transfer of the property does not constitute a money laundering operation under Articles 324-1 et seq. of the French Criminal Code.

5- Sending the goods.

5.1- Dispatch of the goods by the Customer.

The goods must be sent by the Customer to the RAFY GOLD sorting centre, using only the RAFY GOLD kit duly completed, accompanied by the certificate of departure and the present General Conditions of Purchase signed as well as a copy of his/her identity card or valid passport, and proof of address less than three months old. Goods must be sent by registered post with acknowledgement of receipt and declared value. The receipt given at the time of dispatch by the Post Office must be kept as proof in the event of any complaints. In order to avoid any dispute concerning the delivery of items, it is advisable to photograph them before they are sent. If the Customer accepts the offer made by RAFY GOLD, the shipping costs will be reimbursed. RAFY GOLD reserves the right to refuse the kits which would be damaged, opened or even manipulated during transport. In this case 14, the kit will be returned to the Customer without RAFY GOLD being held responsible.

5.2- Compensation in the event of loss of the Property.

In the event that the good sent, in accordance with the provisions of article 5.1 above, is lost during shipment, the Customer may request compensation from Post for the proven loss, up to the declared value.

6- Appraisal and valuation of the metal.

On receipt of the goods, RAFY GOLD will carry out an appraisal by any means.

The Customer acknowledges that this appraisal may require the use of acids on the item, so that the original condition of the metal cannot be guaranteed if the Customer does not accept the offer. The Customer acknowledges that the appraisal of the metal may require the denaturing of the product, in particular the dissociation of the various materials making up the metal.

7- Formation of the contract.

By sending items to 4 RAFY GOLD, the Customer makes a binding offer to sell the item. After appraisal and valuation of the item, RAFY GOLD will decide if it wishes to acquire the item at the price determined by the appraisal. The seller will be informed by mail, email or telephone. After acceptance by the Customer, RAFY
GOLD will proceed to the payment of the price under the conditions defined in article 10 below. The sending of the notification of acceptance by RAFY GOLD constitutes the date of formation of the contract.

8- Transfer of ownership.

The transfer of ownership takes place on the date of formation of the contract as indicated in article 7.

9- Pricing.

The price of the item is determined according to its weight, the number of carats in the gold and its price at the time of valuation.

10- Terms of payment.

RAFY GOLD will notify the Customer of the price. Once the transaction is accepted by the Customer, RAFY GOLD will proceed to the payment by cheque or bank transfer,

11- Withdrawal/Resolution.

If the price proposed by RAFY GOLD does not suit the Customer, the latter has a withdrawal period of seven (7) days to request the cancellation of the sale by registered mail to the following address: TRADING EL, 5 place Charles Béraudier TRADING EL, 5 place Charles Béraudier 69003 LYON, France. This withdrawal period starts to run 4 days after the date of payment.

The Customer who has notified 4 RAFY GOLD of his decision to exercise his right of withdrawal must reimburse the price within seven (7) days from the expiry of the withdrawal period, i.e. a maximum period of fourteen (14) days from payment of the price.

This refund will be made at the Customer's expense and according to the methods used by RAFY GOLD for payment:

- In the case of payment by cheque, the Customer must return the cheque or issue a new cheque to the following address: TRADING EL, 5 place Charles Béraudier 69003 LYON.

- In the case of a bank transfer, the Customer must send the same amount to RAFY GOLD's account, indicating his name and the order number.

In this respect, RAFY GOLD informs the Customer that the transfer may take up to three (3) working days,

RAFY GOLD will return the goods to the Customer within thirty (30) days from the notification of withdrawal by the Customer. In the event that the Customer does not notify RAFY GOLD of his right of withdrawal within the period provided for in this article, or in the event that the Customer does not reimburse RAFY GOLD within the period provided for, RAFY GOLD will freely dispose of the goods so that these goods cannot be reclaimed by the Customer. If the Customer does not retract in the conditions mentioned above, the contract becomes final and the Customer accepts that the elements other than the precious metals are the property of RAFY GOLD.

12- Return of Goods.

In case of absence of precious metals in the sent good, the Customer has ten (10) days 4 as from the sending of the answer by RAFY GOLD to ask for the return of his good. In the event of a return request within the aforementioned period, the good will be returned within ten (10) days 4 from the date of the request. In case of return of the good, RAFY GOLD will choose the carrier in charge of the return of the good. RAFY GOLD will also determine the conditions of insurance of the good for the transport and the procedure of reception of the good. For this reason, the amount of the insurance cover chosen by RAFY GOLD cannot exceed the value of the good as estimated by RAFY GOLD.
by RAFY GOLD, At the time of the return, the risk of a possible loss or deterioration is transferred to the Customer as of the handing-over of the good to the conveyor. The Customer undertakes to examine the integrity, weight and quantity of the goods upon receipt. The Customer undertakes to examine the packaging on receipt & notify RAFY GOLD of any deterioration. If the Customer does not comply with these obligations within ten (10) days of receipt, the return will be deemed accepted. In any case, the return costs will be invoiced to the Customer who will have to pay them without delay,

13- Liability.

RAFY GOLD cannot be held responsible:

- In the event of loss of or damage to property which RAFY GOLD does not offer to purchase.

- In the event of damage resulting from expertise.

RAFY GOLD can only be held responsible in case of non-execution of its obligations. In the event that RAFY GOLD is held liable, the Customer accepts that the compensation that may be awarded cannot exceed the value corresponding to the weight of the precious metals making up the good in its raw form.

14- Modification of the General Terms and Conditions.

RAFY GOLD reserves the right to modify the present General Conditions.

The Customer remains subject to the General Terms and Conditions in force at the time the goods are sent to 4 RAFY GOLD.

15- Taxes.

Sales of gold and precious metals are subject to a tax of 7.5% of the sale price as well as the Contribution pour le Remboursement de la Dette Sociale which amounts to 0.5% if the seller resides in France. RAFY GOLD undertakes to pay this sum to the French State on behalf of the Customer. The Customer is therefore exempt from any tax claim and has no interest to pay on the sum he will receive from RAFY GOLD. However this tax is not
applicable to jewellery and collectors' coins dating from before 1800.

16- Hazardous materials.
The Customer agrees not to send RAFY GOLD any hazardous materials.

17- Applicable law/ Disputes. :
French law is the only law applicable to the present General Conditions as well as to the contracts concluded between the Customer and RAFY GOLD. Any dispute which cannot be settled amicably will be submitted to the courts whose jurisdiction will be determined according to the rules of common law.
